"SSI said Disney had known for years it had hired private investigators to look for documents in dustbins but had not objected."

I don't care about the actual legalities. This is one of those things which, to nick a phrase from venta, is Just Wrong.

I wouldn't worry too much - Disney has never lost a case.

Sadly, it can come down to a very simple point: did SSI have an archive or destroy clause in their contract?

Mainly the fact that this is a line about a court case. And Just Wrong, because that's my first impression (as in original Just Wrong (http://www.livejournal.com/users/venta/70755.html#cutid1) discussion).
